Article 1: Scope
1.1 This privacy policy (the "Privacy Policy") shall apply to all personal data held by (i) A-NET BV, with registered office at Industrieweg 57B, 3583 Beringen and with company number 0689.769.077, (ii) ELECTROBUILD BV, with registered office at Hermesstraat 4/A, 1930 Zaventem and with company number 0456.240.884, (iii) A-NET HOLDING COMMV, with its registered office at Industrieweg 57B, 3583 Beringen and with company number 0792.499.304, (iv) A-NET IMMO BV, with its registered office at Buntjesstraat 41, 3583 Beringen and with company number 0462.884.592 and (v) M.H.S. BV, with its registered office at Buntjesstraat 41, 3583 Beringen and with company number 0819.891.510 (hereinafter together referred to as "we", "we" or "A-Net") processed.
1.2 In order for A-Net to provide a good service, we work with personal data. By means of this Privacy Policy we want to give you more explanation about the way we handle the personal data we have.
1.3 By using our website https://a-netservice.be/ (hereinafter the "Website") and/or our services, you acknowledge that you have carefully read this Privacy Policy and agree to it, without any reservations.
Article 2: Definitions.
2.1 Personal data include all data by which a person can be directly or indirectly identified, such as name, first name, address, telephone number, IP address, billing information,... Also included are all data that either directly or by combination can lead to the identification of an individual.
2.2 Process In practice, includes any use of personal data, such as its collection, storage, modification, access, dissemination or erasure.
2.3 The controller determines what personal data are processed, what means are used to do so, and for what purposes.
2.4 Processors are parties that process personal data on behalf of the controller. We enter into a processor agreement with each processor as a framework of agreements in order to best protect your personal data.
Article 3: Protection of personal data (general provisions)
3.1 We consider it important to handle your personal data with care. We therefore do so in accordance with European data protection legislation (the "General Data Protection Regulation", abbreviated as "AVG" or "GDPR") and the relevant local legislation that implements the AVG, including, among others, the Law of July 30, 2018 on the Protection of Natural Persons with Regard to the Processing of Personal Data (hereinafter referred to together with the AVG as the "Privacy Act").
3.2 We process only the personal data necessary for the purposes pursued. In doing so, we guard the completeness and accuracy of your personal data.
3.3 In principle, we do not retain your personal data longer than necessary for the purpose for which it was collected (see in detail Article 8).
3.4 We also take the necessary security measures to adequately secure the personal data we process. In particular, we take the following measures:
- Your personal data are accessible only to those who need them to perform their duties;
- Everyone involved in the processing of your personal data, both our own employees and external parties, is also required by law or contract to keep it confidential through a confidentiality commitment in their contract;
- Restricted access to servers where personal data is kept (enter passwords to get into program).
3.5 Under no circumstances can we be held liable for any direct or indirect damage resulting from an erroneous or unlawful use by a third party of personal data, unless that third party has been engaged by us.
3.6 You must at all times comply with the security regulations. Therefore, you are solely responsible for the use made from the Website of your computer, IP address and of your identification data, as well as for their confidentiality.
3.7 When we engage processors, we set out the framework of agreements on such processing in a processing agreement. Such processing agreement covers, among other things, the purposes and lawfulness of the processing and the security of personal data.
Article 4: What personal data do we process and in what ways?
4.1 We may process the following personal data:
- When visiting the Website: including your IP address and your choice of language, browser type, geographic location, preferences, operating system, etc. ("technical information") and through cookies (see Cookie Policy: a-netservice.be/cookie policy)
- When filling out the contact form: name, first name, e-mail address, phone number and any other personal information you provide in the message;
- In any other contact with us, for example by e-mail or by telephone: the data you provide us with when contacting us.
Article 5: Why do we process your personal data (purposes)?
5.1 We collect and use your personal data only if we have established a clear and legitimate purpose for it.
5.2 We collect technical information for maintaining and improving the Website and compiling anonymous visitor statistics.
5.3 We also collect personal data (e.g., identity data) for the purpose of (i) being able to perform a contract (ii) fulfilling a legal obligation, or (iii) to contact you in response to a particular inquiry you make to us.
5.4 We will therefore process your personal data, inter alia, to conclude and perform an agreement with you, to comply with a legal obligation or for our own legitimate interests. If you cannot provide the necessary personal data, we cannot guarantee that we:
- will be able to enter into an agreement with you;
- be able to process your request;
- be able to contact you.
Article 6: May we process your personal data (legal basis)?
6.1 We process the personal data you provide through the Website and/or by e-mail and/or by any other means on the basis of the following processing grounds:
- to fulfill a legal obligation, e.g., if a government agency forces us to transfer certain personal data;
- When you have given your specific consent to do so, e.g. via contact forms, verbally, by email, etc;
- For the performance of a contract with you.
Section 7: Do we share your personal data with others (whether outside the EU or not)?
7.1 We do not share your data with third parties except in the following cases:
- you give us prior authorization to do so;
- we are required by law to do so;
- they are requested as part of a (judicial) investigation;
- If we use an external company (e.g. our website builder, a software firm or specialized consulting firm) to perform a task, they may only process your personal data within the framework agreed with them and after complying with the provisions of the Privacy Act. To this end, we have concluded the necessary processing agreements with these external companies.
7.2 We will not sell, rent or commercially make your personal data available to third parties except with your prior consent.
Article 8: How long do we keep your personal data?
8.1 Your personal data will only be processed for as long as necessary to achieve the purposes. They will therefore be kept for the period necessary to achieve the purposes or meet legal requirements (including in the field of accounting or under specific legislation).
Article 9: What are your rights?
9.1 In accordance with the Privacy Act, you have the following rights with respect to your personal data:
- Right of inspection;
- Right of improvement;
- Right of erasure;
- Right of restriction;
- Right to object;
- Right of transferability.
9.2 If the processing is based on your prior consent, you of course always have the right to withdraw that consent.

9.4 We will make every effort to respond to you as soon as possible and at the latest within 30 (thirty) days of receiving the request.
9.5 We reserve the right to request additional identification for identification purposes.

Article 10: Changes
10.1 A-Net reserves the right to make changes to the Privacy Policy at any time. By using the Website and/or using our services, you accept all the terms of the Privacy Policy as determined at the time of use. Upon any access to the Website, after the Privacy Policy has been modified, you will be deemed to have read the changes and accept them to the extent such changes are visible in the modified Privacy Policy.
